The “Enter to win: 4 Day-3 Night Mini-Vacation” (“Sweepstakes”) begins on August 9, 2023, and ends at 11:59:59 p.m. EST on August 9, 2024 (“End Date”). The Sweepstakes is sponsored by Capital Resorts Group, LLC d/b/a Capital Vacations, 2024 Corporate Centre Dr., Suite 101, Myrtle Beach, SC 29577 (“Sponsor”). Sponsor is the official time keeper of the Sweepstakes. Eligibility: The Sweepstakes is open to legal U.S. residents age of 18 and over on the date of entry. This Sweepstakes is void where prohibited or restricted by law and is not directed towards residents of any jurisdiction in which registration and/or licensing is required but which registration and/or licensing requirements have not been met. Employees, officers, directors, agents, representatives, and their immediate family and/or household members (whether or not related) of Sponsor, its affiliates, and its agents are not eligible. This Sweepstakes is subject to all applicable U.S federal, state, and local laws and regulations. By submitting an entry, entrant fully and unconditionally agrees to accept, and waive any right to ambiguity in, the Sweepstakes and these Rules. How to Enter: 1) complete a Sweepstakes Entry Form and mail it to Sponsor’s address above or (2) enter online at https://capitalvacations.com/land/perfect-scape. Limit of one (1) entry per person/household. Proof of emailing or electronic submission does not constitute proof of delivery or entry. The name, address, telephone number(s), and email address (collectively, “Contact Information”) provided by each entrant in the Sweepstakes Entry Form is the contact information of record regarding all communications with each entrant; any changes to such contact information may serve as a basis for disqualification. Each entrant must be the rightful owner (or have authorized use) at time of entry of the email address listed on the entry form. If there’s a dispute as to a winner’s identity, the winner will be deemed to be the person in whose name the e-mail account for the email address was opened (Sponsor may require proof thereof). Entrants must provide all Contact Information to be eligible to win, and consent to Sponsor’s use of Contact Information for Sweepstakes administration and prize fulfillment. Incomplete, unreadable, misdirected, invalid or unintelligible entries will be disqualified. Mailed Entries must be postmarked on or before the End Date and received no later than 11:59:59 EST on August 7, 2024. Prize: One (1) winner will receive a 4 Day 3 Night Mini-Vacation Certificate, with a retail value of $1,500.00 per prize, subject to availability. Resort Options will be listed on the 4 Day 3 Night Mini-Vacation Certificate. Terms and conditions on the Certificate apply. Limit of one (1) entry per household. In order to be eligible to participate in the Sweepstakes for the Prize, you will be required to meet the Sponsor eligibility criteria. Resort Options will be determined by Sponsor and provided to Winners. Additional qualifications and restrictions may apply. The Sweepstakes for the Prize period ends when Sponsor elects to end the Sweepstakes, or on the End Date. Odds of Winning: Estimated odds of winning the Prize are 1 in 10,000; however, actual odds of winning the Prize depend upon the total number of eligible entries received. Other Conditions: Prize cannot be transferred or substituted, except by Sponsor due to prize unavailability, in which event a prize of equal or greater value may be used. Any prizes given for resort stays will be at a resort designated by Sponsor. Travel and/or use of any of the Prizes must be completed within twelve (12) months of prize award date. Prizes are subject to resort availability and blackout dates and restrictions may apply. Prize may not be redeemed for cash. Except where prohibited by law, winner’s prize acceptance constitutes agreement for the Sponsor to use winner’s name, photographs, likeness, statements, biographical information, voice, city, and state of residence for advertising purposes on a worldwide basis in all forms of media and on the internet, without compensation. Sponsor and its respective subsidiaries, affiliates, employees, officers, directors, shareholders, affiliates and agents (collectively “Related Parties”) are not responsible for and will not be liable for; (i) late, lost, damaged, misdirected, incomplete, unintelligible entries; (ii) telephone, electronic, hardware, software, network, Internet or computer malfunctions or transmission failures of any kind; (iii) any condition caused by events beyond the control of Sponsor that may cause Sweepstakes to be disrupted or corrupted; or (iv) printing or typographical errors in any Sweepstakes materials. Indemnification: By participating you agree to release, indemnify, defend and hold the Related Parties, harmless from all losses, damages, injuries, rights, claims and actions, of any kind (including attorneys’ fees), in whole or in part, directly or indirectly, in connection with the Sweepstakes, or acceptance, possession, use or misuse of any prizes, including without limitation, personal injury, death and property damage, and claims based on publicity rights, defamation or invasion of privacy. Prize Drawing & Notification: The winners will be selected from all eligible entries received in a random drawing that will be held on August 10, 2024, at Sponsors’ office. Winner will be notified by email or telephone, and must complete, execute, and return a W-9 form (required to issue the winner’s 1099 forms), an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release (collectively “Affidavits/Releases”) within 5 calendar days of notification in order to claim his/her prize. Failure to complete these steps within the 5-calendar day period will result in disqualification of the selected winner, and a new winner will be selected from eligible entries in a commercially reasonable period. Sponsors are not responsible and will not be liable for late, lost, misdirected or unsuccessful efforts to notify the winner. If the winner cannot be notified within 5 calendar days of the drawing, or fails to comply with these Rules, the winner will be disqualified and an alternate winner will be selected. Subject to any required governmental approval, Sponsor reserves the right to, without prior notice and at any time, terminate, cancel, or modify the Sweepstakes, in whole or in part, if any factor interferes with its proper conduct as contemplated by these Rules or if it becomes technically corrupted or due to non-authorized human intervention. ENTRANT HEREBY WAIVES ALL RIGHTS TO BRING A CLASS ACTION SUIT OR TO CLAIM, PUNITIVE, INCIDENTAL, MULTIPLIED, INCREASED, OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES, INCLUDING ATTORNEYS’ FEES. Promotional Offers: By registering for this promotion and providing your consent and Contact Information (name, address, phone number(s) and email address) on the entry form, you (i) authorize Sponsor and its agents to collect, use and disclose the personal information you provide to offer you vacation and travel promotions, products and services, including without limitation, the opportunity to purchase a CRG vacation package to a Capital Vacations Club (“CVC”) destination area or a CVC timeshare interest (collectively “Vacation Offers”), and (ii) expressly request and agree to be contacted by mail, email, and/or telephone at the addresses and/or numbers herein provided (including through the use of an automated and/or predictive dialer, in which case a pre-recorded message may be left on your answering machine or voicemail by CRG and its affiliates and agents, concerning this and future promotions and Vacation Offers, where allowed by law.
